Wow. 7 months have passed since I posted an update!... more than a year since this saga started. Domain renewals are due in a couple of days... $s to make it happen are sitting in my PayPal account thanks to kind people. $16.50 and I can continue sharing my experience with the world for another year. If only this saga was over; if only Rob would cough up the dough; I could just let them expire and forget it ever happened...

Have been taking a break from this saga. I doubt there is many people coming back to check for updates, but I've just added a couple of new posts to the guestbook. These include an Email I received from Robert Shilimon; and several voicemails left following my last post; in one voicemail Robert Shilimon refers to the Email he sent; confirming beyond any doubt that it is his voice, and that he is responsible for the ongoing harassment... but no one in law-enforcement cares about those breaches of clearly defined law.

Calls just resumed, at 5:33pm I answered a call from a blocked number; recognised the callers voice and hung-up. At 5:34pm there was another call from a blocked number which I sent straight to my voicemail. The calls led me to check the guestbook and see a post from only a few minutes earlier from "ROB THE RIPPA". All of these things constitute breaches of Section 474.17 of the Commonwealth Criminal Code.

Mate, I'm doing it tough because I had a project run way over the estimate; by a couple of weeks! Unexpected delays and a little extra effort was required to do the job to a standard. But being an honest business man I stuck very close to the estimate when invoicing the job. You may need to find a dictionary and lookup the work "honest".
"DEFAMING"; suggests unfounded personaly attacks or lies; nothing here but facts supported by evidence and independent witnesses, and the odd "Fair Comment".
You keep saying "LIES"; but you've never been specific, no-one wonders why... we all know the answer.

*Molestation: Annoy or pester a person in a hostile or injurious way; attack or interfere with a person - Conduct 
may amount to harassment or molestation of a person even though it does not involve actual or threatened violence 
to a person or damage to property belonging to, in the possession of, or used by the person.)

Have been contacted today by an eBay buyer that says he too was Ripped off by Rob/Turbo-World.
 
At this stage I have nothing to verify the claim, and no names or specific details of the item purchased will be published until I do... a brief summary however that should not be treated as fact until it is supported & verified;
 
According to the buyers account of events the item he received turned out to be an inferior knock-off of the item advertised, after providing evidence to PayPal they agreed with the purchaser, refunded his money, and told him to "DESTROY AND DISGARD" [sic] the item. Awesome result right?!... well... according to the info I've received, first there was threats, according to the buyer; "he rang me and told me that if i did not return his money or the turbo he was going to come to my address and break every bone in my face.", these threats were apparently quelled by Police intervention, but apparently now Rob, or possibly one of his brothers, has filed a case against the buyer in the Small Claims Court?!?...

I will reiterate at this point that there were no payment terms stipulated in the contract of sale that was formed between myself and Mr Robert S_______; the only terms that were proposed came from me, and with ample opportunity there were no objections whatsoever raised by the Seller.
 
And, let us hypothesize for a moment, that I'd paid for the vehicle in one payment... would that have changed the fact that the vehicle was stripped??? Would it have changed the fact that the vehicle advertised as a complete and going concern, that I agreed to purchase on 4/4/2010 was a pile of disassembled parts on 23/4/2010? And more importantly would it have stopped Rob being a dishonest money-grabbing scumbag?... or would he still have shown his anti-Australian racial prejudice and scumbag tendencies, and taken me for some "AUSSIE GRONK"?

Can anyone guess where this IP is geographically located?  No prizes for guessing I'm afraid.
 
I have contacted the site responsible for the group and asked them to divulge which, if any, of my personal details were provided; since supplying personal details would surely constitute a breach of criminal and privacy Acts(?).

I've been trying to put this out of my mind as much as possible; it's been consuming far too much of my time, energy and sanity. Sorry there have been no updates for a couple of days...
 
 
Well yesterday a person claiming to be, and sounding just like Rob took the menacing calls to a new level. While I was out of town on a job he called me claiming outright to have sent someone to my home; "to give me something"... he went on to claim that his representative had visited my home and was told that I did not live there anymore.
 
After ending this call I was unable to get in touch with my partner or children, my partner's phone rang out, and my daughters phone would not connect. To say that I was frantic at this point wouldn't begin to describe my state of mind. I was calling Police; the local CIU AND General Enquiries numbers rang-out a number of times! I left a message for the detective in the CIU, I did not know if I would be justified in calling 000(?), I resorted to calling a good mate, who I am most grateful to, for driving to my home and see what was going on.
 
I have not had any reply from the message I left with Police.

This should go without saying, but I feel I should state categorically that; I do not know this caller; to the best of my knowledge I do not know anyone by the name of Robin Banks; at no time have I asked anyone to commit a violent act on my behalf, or offered to pay anyone for such an act; I have never been in possession of Cocaine, or supplied it to anyone.
 
Forgot to add previously, 2 additional voicemail messages were left at 2:59am and 7:55am, just the usual calls to menace, harass or cause offence.

I got asked by a journalist, what have the police done for me?...
 
So far, I’ve been the victim of a fraud; (82) obtaining financial advantage by deception. I've received threats; (20) Threats to kill, (21) Threats to inflict serious injury. I’ve suffered from (27) Extortion with threat to kill. I’ve had my identification information along with libel plastered across public forums; (192B) Making, using or supplying identification information & (CRIMINAL CODE ACT 1995: 204) Unlawful publication of defamatory matters. Acts of violence and murder have been publicly incited; (321G) Incitement. And now I suffer through HUNDREDS of calls which menace, harass and cause offence; (CRIMINAL CODE ACT 1995: 474.17). I’ve collected and collated the evidence… at some point I am confident Law Enforcement will pick this up and run with it.

After receiving calls at 7:01pm, 7:46pm, 7:47pm (2), 7:48pm, 7:49pm (3), 7:50pm (2), 7:51pm (3) and 7:51pm I'm left with little choice but to turn my phone off for the remainder of the night. Once again I advised them of the breach of Australian law; they laughed, and then responded with "do you know what i reckon, I reckon you and Mario can go suck you * * *"

More calls today. The caller is blatantly ignoring of the fact that they have been advised on numerous occasions that they are in breach of Section 474.17 of the CRIMINAL CODE ACT 1995, "using a carriage service to menace, harass or cause offence"... Even though they've been advised that the offence carries a jail-term of up-to 3-Years. It seems as though this persons wants to go to jail, or that they have absolutely no respect for the law in this country.
 
Calls received at: 12:13pm, 12:43pm, 12:54pm, 12:55pm, 12:56p, 12:57pm (put phone on airplane mode) - 3 messages left on voicemail at 12:58pm, 12:59pm, and 1:03pm; then another call received at 1:58pm. Another blocked number called me at 4:32pm but I chose not to answer/record it as I was in a client meeting. With the exception of the first call, all calls were recorded; all recordings will be passed on to Police.

Had good conversations today with my Solicitor, followed a short while later by the local Police detective who is responding to my enquiries; all very positive.

The calls continue. Menacing and harassing my in foreign languages, playing music into the phone microphone. Now even playing something pre-recorded which teaches a person how to insult another in hebrew. Recent calls were received at;
1:39pm, 1:42pm, 1:44pm, 1:47pm, 1:51pm, 1:54pm, 2:02pm and right now as I type at 2:06pm; some pathetic low-life scumbag carrying on in a language that I do not understand. Calls recorded. Calls will be passed on to Police.
Maybe they're hoping I'll run out of space to record? Well I've currently got 17-hours remaining, and then it takes about 1 minute to move all the files off & start over.

This website is a factual account of events with all information supported by evidence and witnesses. The purpose of the website was to make my plight known, cause the seller to consider his actions, and prompt him to make an apology along with financial reparations. I was willing to accept the possibility that the seller was an honest person that had made an isolated error in judgement. In the face of overwhelming scrutiny and support for my cause the seller has repeatedly escalated his ludicrous behaviour, breached numerous Australian Laws, and armed me with a wealth of evidence proving what a lowlife scumbag [honest opinion] he really is.
 
It was my intention to remove the full story along with the facts and evidence once financial reparations had been received. Instead of an apology and refund I have received a constant onslaught of threats, menacing behaviour and harassment; along with personal attacks and libel targeted at my character; taking all of this into consideration my inclination to remove any information has been reduced significantly.
 
I now want to make it very clear that if financial reparations are not made in full prior to June 1, 2010 this website will become a permanent fixture of the internet, and its content will be mirrored across numerous web servers world-wide. I previously promoted the site on around a dozen Australian forums which has resulted in 73885 hits to date. Links to this site are the top result if anyone, such as a prospective employer ever happened to Google the name of the seller.
 
Justifiable financial reparations sought to-date include;
Money's paid towards vehicle: $4000
Transport and accommodation costs incurred: $475
Legal costs incurred to date: $500

These people who have aligned and associated themselves with Robert S_______ (who has stated he is being treated for a mental illness), through their actions have shown that they have; no regard for Australian Law; no discernable morals; serious social shortcomings; threatened violence, menaced and harassed; demonstrated a disturbing fixation with paedophilia.
 
In at least one recording it sounds as though they have shown a total lack of regard for the child's physical wellbeing by subjecting it's sensitive hearing to the overwhelmingly loud noise of a race-ported rotary engine being abused; in the recording the child can be heard screaming after this ordeal.
 
Should these people be responsible for an infant?
What on earth is the mother of the infant thinking? Seriously.

The caller(s) have now taken to putting the phone in front of an infant, and coaxing the infant to repeat his words. Pathetic.
 
I have serious concerns for the wellbeing of the child in the care of these disturbed individuals.
 
So far today I've had calls at;
10:33am (immediately after turning my phone on), 10:34am, 10:38am, 10:44am (turned my phone off again), 12:14pm (shortly after turning my phone back on), and 12:21pm. 2 messages were left on my voicemail while my phone was off. All of these calls have been recorded; all of the recordings will be passed on to the Police.

So far this evening I have had 13 calls which were intended to menace, harass or cause offence;
10:53pm (2), 10:59pm, 11:00pm (2), 11:03pm, 11:05pm, 11:06pm, 11:07pm, 11:08pm, 11:10pm, 11:15pm & 11:24pm.
 
I advised the caller(s) clearly that they were in breach of Section 474.17 of the Criminal Code Act 1995, using a carriage service to menace, harass or cause offence. I went on to advise them that this section of the act carries up to 3-years imprisonment as a penalty. The calls continued, I repeated the same message.
 
During one attempt the caller (the same caller that can be heard in later calls), claimed he wanted a website built; somehow he must think this will avoid the call being classified as menacing, harassing or causing offence. Too late buddy, just one call in a long ongoing pattern; what it did do was give a nice long recording of your voice for future comparison.
 
All calls answered were recorded. All recordings will be passed on to the Police.
 
In the most recent calls the only noise that can be heard seems to be the unmistakeable sound of a Ported Rotary engine being idled, in the last call I answered this sounded very much like it is being being intentionally thrashed/destroyed.
 
As has become a habit in recent days, my phone will now spend the rest of the night in "airplane mode", the callers will no doubt spend the rest of the night filling my voicemail with more evidence.

More calls, messages overnight. In addition a person registered on trackchat.com.au this morning as "bernie10max", and posted libel. The posts were made at 6:15am, 6:28am, 6:41am, 6:54am (2), and 6:59am. According to site admins/mods that found them the posts were made from the IP address: 115.128.3.173 (look familiar?)
 
It is worth noting for the record that in many recent calls a number of people can be overheard making themselves party-to the threats, abuse & intimidation; and therefore exposing themselves to prosecution for a breach of Australian law which carries a penalty of up to 3-years imprisonment: Section 474.17 of the Criminal Code Act 1995 "Using a carriage service to menace, harass or cause offence"

Overnight I had calls at 9:04pm, 1:27am, 2:40am, 2:41am and 6:55am; all went to voicemail where abusive/threatening/intimidating messages were left. These have been recorded and sent to the Police.
 
This evening I have so far had around 12 calls at 5:43pm (2), 5:44pm, 5:46pm, 5:47pm, 6:14pm (2), 6:17pm, 6:27pm, 6:28pm (6 & 1/2 minutes of yelling in a foreign language [lebanese?]), 6:42pm, and 6:43pm. During most calls the caller just made pathetic noises. All of the calls answered were recorded, all of the call recordings have been passed on to the Police.
 
If anyone living nearby can translate Lebanese to English please let me know.

I'm a peaceful guy, I hear everyday how people are amazed how I've kept my cool through this. But the effect is overwhelming and I've had enough. So it piqued my interest when, while reading, I discovered another section of the CRIMES ACT 1958;
 
SECTION 9AG. Duress
 
I think "Duress" adequately describes the effect that the actions of Mr Robert Shilimon are having on me and my family. I believe the Latin term: "Duress per minas" fits with the legal definition nicely. Mr Robert Shilimon has directly threatened a violent act serious enough that he expects to be incarcerated as a result. Nothing thinly veiled about that one.
 
Let me make it very clear that at this point; I believe that a threat has been made that will be carried out unless the police take action; failing action by the police I believe that the only reasonable way the threat can be avoided is by me making it impossible for the threat to be committed, by taking whatever action is necessary to prevent it.

Just had an unexpected phone call from Mario. Apparently someone used the identity "PROFIX" to create an account on an internet forum to commit libel against Incar Racing. Thankfully the original comments have been removed. Mario assured me that he knew this was not me; and that he was confident he knew who it was (wild guesses anyone?). I will be in touch with the forum admins/mods later today to obtain whatever IP Address/Date/Time info I can with regard to the user and the posts.
 
Mario/Incar: If you feel this has hurt your business in any way I would highly recommend seeking advice on a defamation claim.

This morning I awoke to find an email notifying me that I had registered on trackchat.com.au [EDIT: and now on kombiclub.com] with the username: Mathew Harding; this was very strange for at least three reasons;
Because I have two t's in my name,
Because I am already registered user of those forums under the name bernieL0max!
And because when I register with a forum/website/etc. I create a new email alias for each one, I don't re-use addresses like itservices@
This last precaution helps me keep track of where spammers etc get hold of my Email address, and enables me to write rules managing incoming messages.
 
So it appears as though *someone* is trying a new tact. Please be aware of this behaviour if you come across a post claiming to have been submitted by me on ANY forum; please notify me if you do come across anything like this.
 
Forum mods and admins; please retain the IP/date/time info from any such registrations/posts.

The seller has stated that he is being treated with medication for a mental illness, and has made clear threats and stated his intention to cause me harm. He has stated that he will go ahead with his intentions even though, in his own opinion, he fully expects to be incarcerated as a result.

Apparently he is also seeing a "PSYCHIC" daily...  ??  I for one sincerely hope this is a malapropism for the word "Psychologist" or "Psychiatrist".
  
Also received a new eBay Message, from the seller blaming me for "DESTROYING [his] LIFE"; and accusing me of publishing lies about him.

The seller has $4000 of my hard-earned money; cost me hundred of dollars more through his deceit; has gone on to threaten and abuse me and my family; and that is your entire response? This seller is free to continue on? Free to grossly misrepresent the things he has for sale? and pocket the hard-earned money of innocent and trusting individuals? It is my opinion, which I believe will be shared by many readers, that your complacency in this situation is absolutely pathetic.

I wonder how many of his past eBay profits made it onto a Tax Return?... just wondering is all... not accusing anyone of anything.
 
Does anyone else think it is strange that he didn't have to suffer through the usual waiting period for benefits? Hope his stories and application answers all match... just saying is all... no accusation.
 
Buying and selling new products like Turbo-chargers clearly makes 'Turbo-world' a business right?... good thing because it makes the people at the Office of Fair Trading a lot happier.

First Rob reports that his family sacked him, presumably because of the shame and disrepute he brought on the family... the latest rumour I hear on the grapevine is that the family are now backing Rob in legal action against me! I wonder what would cost them less and have a more positive outcome; further victimising the victim, or helping their son repay the money that I paid in good faith?

I cannot release the recording online or it cannot be used as evidence, the transcript however is a different story; (Apologies in advance for the language).

Monday, 10 May 2010 @ 10:00am.  I awoke today to find yet another post in my guestbook made under my own name, going too far. I had previously removed all of Rob's personally identifiable information as a gesture to stop the threats and taunts against me and my family; this did not happen so the censoring has stopped also.
 
Oh yeh, and today I had my second ever contact from eBay (the first being an order to remove the FALSE address information ROB had supplied via eBay messaging)... today eBay have messaged me to make me aware that the non-paying bidder case against me has been closed! Along with a warning that my account might be restricted! An automated form letter I know... but common eBay, lift your game!

Rob: I am not "[your] dear friend". I am the person you tried to rip off, but managed to catch you in the process. I am the person who you then threatened, not happy with that you then threatened my family. I have told you clearly and I will tell you again "DO NOT CONTACT ME", send any further communications through my solicitor. If you suddenly get the urge to refund my money you have my bank account details on the receipts you were supplied.

Wednesday, 5 May 2010 @ 6:53pm.  In response to a couple of questions regarding what will happen to the site when the money is repaid...
 
Even before the money is repaid, very soon in fact; I want to start evolving the site into somewhere that people can some to get information on what steps to take when buying and/or selling vehicles online. I would like to include such things as;
  • A guide for inspecting vehicles; what to look for, what questions to ask
  • A geographical database of qualified mechanics & businesses that will inspect a vehicle, their location and the distance they will travel to conduct an inspection, service levels, costs, etc.
    • The Ability to search this database based on the location of the vehicle
  • A guide for transferring vehicle registrations interstate
  • A guide for transporting a vehicle interstate
  • etc (suggestions?)

If anyone would like to contribute ideas or content to the site, or discuss partnership opportunities I invite them to contact me.

I also think it is crazy the number of individual law enforcement agencies, government agencies, misc organisations, etc. that a person needs to contact after a bad experience, so I would like to develop (with assistance), a guide to help people through this process. I recently had an email from a gentleman by the name of John V who provided a quite comprehensive list of the agencies and organisations to talk to if something like this takes place in Victoria! Thanks John.

A quick query of the logs shows 23,169 unique IPs that have accessed the site; as pointed out previously, when you take into account Proxy Servers, Shared Internet Connections, Network behind NAT, etc, the actual number of unique viewers would be a significantly greater number!

Still, I can't keep everyone happy & I'm not twisting anyone's arm! Most who've browsed to the donations page will realise that I do my best to talk you out of it. I just need that 1 benefactor who has enough dough under his or her pillow to start a racing team :) lol

Up until yesterday I wrote the entire site in notepad... then I got silly and opened it in Word to do a spell-check... now I can't read the code anymore! lol.
So, news... I'm sitting here in my first RippedOffByRob.com t-shirt! Thanks again to Tee Junction. We might try and snazzy it up a bit between now and when Zhen is ready to do a small run of them. I've had some interest but not enough to commit to a minimum order of 50 t-shirts yet... so let me know! :)

Some extra info to post at this time, have just done some simply queries on the webserver logs, at the time of writing the site has had hits from 18,638 unique IP addresses, taking into account proxy servers, shared internet connections, networks like Telstra 3G behind NAT, etc, the actual number of unique viewers would be significantly higher. The other information that is garnered from that is that people are coming back again and again to get updates, this is definitely appreciated! Now if I can just get 18,000 posts in my Guestbook :)
Interesting... I've just learned that on some forum somewhere someone has suggested this is a viral marketing attempt by PayPal. Doesn’t sound like they've read the full account of events. The 2 biggest things I have taken from this are NEVER, EVER BUY A VEHICLE OFF EBAY WITHOUT A. INSPECTING IT, or B. GETTING SOMEONE TO INSPECT IT. And second this is ALWAYS USE PAYPAL, or I guess some kind of escrow service if the seller is happy to wait for their money until the item changes hands.  
The references to PayPal at this point are me poking a little fun of myself and taking the opportunity to get the message across; I'll be honest, I'm hoping they will come to me and say "Hey Matt, love what you're doing; would you like a bit as assistance in turning this into a fully fledged site providing a much needed resource to potential internet buyers and sellers?". I'm probably dreaming I know, but I'm motivated to make something good come of this with or without their help.
The threats I have received have forced me to make a choice for the safety and well being of my family. I have removed all of the information on the site that specifically identifies the seller in this case (apart from his First Name, eBay ID, and Email Address which are included in the supporting information; It is an unfortunate result of his own actions that he may have to change some or all of these things.  
OK, so I've been receiving thinly veiled threats (see SMS log), as well out outright verbal threats [one recording clearly says "Hope you kissed your family goodbye"]. Not sure how the seller wants me to react to these; am I worried? Of course I'm worried. If this joker drives 1000km and steps onto my property he can only be seen as an aggressor and a threat to me & my family, I've contacted the police & they are also very concerned. The Police advised me that the verbal threats over a telephone line account to a Federal offence which they assure me are being taking very seriously. The police also advise that should anything happen to me, my family, my home or my property; that they will be looking closely for a link to Mr S_______.

WOW... I'm getting messages of good will and sympathy from all around the world, the UK, the US, I've had offers to host the site for free in the US to make it faster! I've learned that David Thorne has tweeted the site to around 27,000 followers! The response has raised my spirits like nothing else could. Again, I know this is not a huge amount of money, I know in these economic times people have lost so much more from savings, investments, superannuation, etc. which makes the response nothing short of amazing.
Today eBay ordered that I remove any the contact information from the site that I received via eBay's private message system... the funny thing the only address I received via this system was FAKE!... does that mean I still have to remove it?
Someone suggested I take orders for T-shirt with "I was RippedOffByRob.com" printed on them... hmmm...

I know I sound like a bit of a sook about $4000, but I have been at a very low point for some time, and this was supposed to be a positive experience to begin to bring me around. At this stage if I got my money back I'd almost thank Mr S_______ for his efforts which showed me that people give-a-shit. :)  
We've reached 2000 hits in far-less than 24-hours, I am receiving many supportive messages via email and forum posts. This morning I made the seller aware of the site. I need to give him every opportunity to consider the situation, his reputation, and to do the right thing.
